Mum’s fury after her daughter, 11, is killed in horror crash but driver WON’T face charges despite ‘drink and drugs in his system’

Police told her there is no way to prove the driver was speeding and that the amount of drugs in his system was under the legal limit

THE mum of a schoolgirl killed while riding her bicycle feels "cheated" after hearing the driver of the car which struck her daughter will not be facing charges.

Nicola Rogers' daughter Jodie died after she crashed with a blue BMW on September 25 last year.

The 11-year-old was airlifted to a local hospital before being transferred to Leeds General Infirmary after she was knocked down in Grimsby, but later died.

The devastated mum says all she wants is "justice for Jodie".

The driver, a 36-year-old man, was initially arrested on suspicion of driving while unfit through drink or drugs, but has since been released on bail and will not face charges.

Nicola, of Cleethorpes, North East Lincolnshire, said: "I was told that although drink and drugs were found in his system there wasn't enough for him to be over the legal limit.

"Cannabis was found to be in his system and that is an illegal drug, how can there be a legal limit on an illegal drug?

"We want a zero-tolerance on drink and drugs and getting behind the wheel, if you want a drink then you don't drive.

"If this man had wanted a drink and wasn't then allowed to drive my little girl would still be here today."

Police investigated the death, but Nicola says officers told her there was no way to prove the driver was speeding and that the level of alcohol and drugs in his system was below the legal limit.

The police have told her she could appeal and ask for the case to go to trial, but the outcome would be the same.

Nicola, who is expecting her sixth child with her partner David Stevenson, wants the legal limit to change so there is a zero-tolerance to drink and drug driving.

Of hearing there would be no charges made, she said: "When I first heard I felt angry and upset, I didn't really know how to feel.

"I had mixed emotions when I was told.

"I had an idea it would come to that because it took so long (to make a decision). Later I felt cheated.

"He had been speeding, he had drink in his system, he had drugs in his system, and at the end of the day, no matter what he had done he had still killed a little girl.

"There should have been something done, he should have been charged with something.

"Justice has not be done, he has taken my little girl away and he just gets to carry on with is life, with no charges, no nothing. All we want is justice for Jodie.

A police spokesman said: "Humberside Police conducted a thorough investigation into the road traffic collision on Park Street, Grimsby, on September 25 which sadly resulted in the tragic death of 11-year-old Jodie Rodgers.

"The full case file was passed to the Crown Prosecution Service (CPS), who decided the 36-year-old man driving the car involved would not face charges.

"Specialist Family Liaison Officers have informed the family of the CPS decision.

The file has now been passed to the North East Lincolnshire's Coroner's Office."

A spokeswoman for the CPS said: "It was an evidential decision."
