Married couple ‘molested woman after she turned down a threesome – hours after pair drunkenly rubbed their fake breasts together’
Husband and wife wouldn't take 'no' for an answer
A COUPLE allegedly molested a woman as they tried to entice her into a threesome, a court has heard.
David and Sarah Finan are said to have repeatedly invited the woman to join them in sex after a drunken night out.
The two women had both previously had breast enlargements and earlier in the evening had been rubbing their breasts together and posing while David Finan took photos of them in front of other guests at their home.
But a court heard events took a more sinister turn when the couple took it in turns to try and entice the woman into a threesome.
At one stage David Finan, 41, suggested the two women have sex while he watched.
He and his 37-year-old wife, described as "always outrageous, the life and soul", were, however, persistently turned down.
The court heard the alleged victim even sent desperate text messages asking for help to another woman sleeping at the Finan home on St Mary's Island, Chatham, Kent, during her ordeal in October 2014.
But both David and Sarah Finan are said to have molested her despite her repeatedly rebuffing their advances.
They each deny a charge of assault by penetration but prosecutor Paul Valder told the court at the start of the trial on Monday that this was not a case of misreading signals.
He said: "She was saying 'No' from the get-go."
Both defendants are accused of putting their hands in the woman's underwear.
David Finan is also said to have kissed the woman and groped her breast but he told cops it was all "100 per cent consensual".
He also said he and his wife had never had a threesome before but he had been drinking steadily for about nine hours and the alcohol lowered their inhibitions.
But, he said he "backed off" from the alleged victim when she told him she was already having an affair.
Sarah Finan was said to be drunk and spilling her wine when they returned to their home from their night out at the Ship and Trades pub and Porters bar at Chatham Maritime.

Maidstone Crown Court heard Finan and the alleged victim went upstairs to compare boob jobs and then returned, posing for photos and rubbing their breasts together in front of other guests as David Finan snapped away.
Sarah Finan's breasts were exposed and she kept pulling the woman's top down. The woman told the court she told Finan to stop, and denied they were flirting.
It was after everyone had gone to bed, with the alleged victim planning to sleep on the sofa, that she claimed she was sexually assaulted.
Sarah Finan was first to invite her upstairs, explaining she meant for sex when she was misunderstood. But the woman told her to go and have sex with her husband.
"That was the first time I felt uncomfortable," she told the jury from behind screens, shielding her from the dock. "Sarah didn't look like she was joking."
Asked why she did not leave the house, she replied: "I had no reason to believe it would go any further. She hadn't forced herself on me. They were just words coming out of her mouth. I put it down to her being really drunk, crazy."
It was while she was checking messages on her mobile phone on the sofa that David Finan came down and invited her to join them, the court heard.
She again declined, at which point he said she could have sex with his wife while he watched.
It was at this point the woman sent a text to another guest sleeping upstairs, saying: "OMG. You need to come downstairs now!! Please."
The guest came downstairs and after David Finan had disappeared, she was told what had allegedly happened. But the woman assured her she would be OK on the sofa.
After the guest had gone back upstairs, Sarah Finan returned and sat across the woman's legs, telling her she wanted sex with her.
They were joined by David Finan, who knelt down by her head and allegedly started to kiss and grope her breast under her vest top.
The court heard that the woman continued to text the upstairs guest, asking her to come down.
"She pleaded with David to stop, saying Sarah wouldn't be happy. Sarah said she wouldn't mind.
"The woman told him to stop. He said she should just have sex with Sarah and he would watch. The woman said she didn't want to and wouldn't do it."
David Finan then jumped up when the guest reappeared and pretended to be asleep in a chair. When she asked what was going on, the alleged victim told her: "David wants to know if we want a threesome with them."
Sarah Finan allegedly put her hand down the woman's pyjama bottoms and inside her underwear before she was pushed off the sofa and on to the floor.
The court heard the woman's DNA was later found in Sarah Finan's fingernail clippings.
David Finan returned when the woman was again alone. He started kissing her and told her she was enjoying it. She confessed to having an affair and said she did not want sex with him.
However, he is accused of putting one hand under her top and the other down her knickers. The court was told he stopped when the woman told him to "go to bed and f*** his wife".
The woman had sent further texts to the upstairs guest saying she felt violated after Sarah Finan allegedly groped her.
She later slept on the floor in the guest's room before leaving as soon as she woke in the morning and reporting the incident to police.
She told the court she did not get off the sofa during the assaults because she felt "almost paralysed" with shock.
"It was so surreal," she said. "I had already told him to stop. He knew that he had to stop but he just ignored me. Every time they went away they came back.
David Finan told cops he had no idea why the woman would accuse them of sexual assault.
